The Trustee of the API, Inc. Asbestos Settlement Trust is Robert D. Brownson. Mr. Brownson was appointed as Trustee by Chief Judge Gregory Kishel of the United States Bankruptcy Court, District of Minnesota, in the Order Confirming Third Amended Plan of Reorganization of API Inc. (November 21, 2005) As Modified At Confirmation, dated December 6, 2005. The Plan provides at Article 1.133, that, Trustee(s) means Robert D. Brownson, the Person appointed pursuant to Article 4 of the Plan for the purpose of acting as Trustee of the Trust in accordance with the terms and conditions contained in the Trust Documents, the Plan and the Confirmation Order and any person appointed to succeed the then existing Trustee in accordance with the terms of the Trust.
