API, Inc. Asbestos Settlement Trust Third Party Disclosure Policy
Regarding Individual Claims Information
  1. All requests for information on an individual claim must be received in writing with identification of the Requesting Party and who they represent.
  2. The Trust will respond to the Requesting Party whether the claim has been filed or not. No other information will provided.
  3. If the Requesting Party wants more information and/or claim documents, the Requesting party will be required to have a subpoena issued by a court with competent jurisdiction over the API, Inc. Asbestos Settlement Trust, headquartered in Minneapolis, Minnesota. The Trust will not respond to out-of-state subpoenas.
  4. If the Requesting Party does serve a competent and enforceable subpoena, the attorney representing the claimant or the claimant (if not represented by an attorney) will be sent a copy of the subpoena and the Trust’s proposed response together with the date the Trust will respond to the subpoena.
  5. It will be the Trust’s policy that certain settlement and payment amount information is confidential.
Instructions for Requesting Claim Searches

Due to the expense needed to respond to third party inquiries for information on individual claims, it has become necessary for the API, Inc. Asbestos Settlement Trust to implement a fee for such claim searches.

Effective February 1, 2022, the Trust will require payment of $120.00 per individual in advance for claim searches.

All requests for claim searches must be received in writing (e-mail is acceptable) with complete identification of the individual (Name, Social Security Number, Date of Birth) and the identification of the Requesting Party and who they represent. Payment of the applicable search fees should be paid to the API, Inc. Asbestos Settlement Trust and mailed to:

Pursuant to the API, Inc. Asbestos Settlement Trust Third Party Disclosure Policy, the Trust will respond to the Requesting Party whether the claim has been filed or not. No other information will provided absent a subpoena issued by a court with competent jurisdiction over the API, Inc. Asbestos Settlement Trust, headquartered in Minneapolis, Minnesota.
